Acceptance & Eligibility

• State that use of the app constitutes acceptance of the Terms.
• Define minimum age and requirements for minors.
• Define parental/guardian requirements where applicable.

Account Registration & Security

• Require accurate registration information.
• Explain responsibility for account credentials and security.
• Describe actions permitted when suspicious or unauthorized activity is detected.

Family Accounts & Linking

• Define the family administrator/parent role, if applicable.
• Explain invitation, acceptance and unlinking.
• Define what the administrator and linked member may view or control.
• Prohibit unauthorized monitoring or access to another person's account/data.
• Explain what happens to family data after unlinking or account termination.

Screen Monitoring

• Describe the purpose and scope of monitoring.
• Explain that functionality depends on device permissions and operating-system capabilities.
• State that screen-time measurements may not always be perfectly accurate.
• Explain relevant limitations caused by device settings, permissions, connectivity or OS restrictions.
• Avoid presenting the service as an emergency or safety-critical monitoring system unless specifically designed and legally reviewed for that purpose.

Acceptable Use

• No unauthorized access to accounts or data.
• No bypassing security or monitoring protections.
• No unauthorized surveillance or misuse of family-monitoring features.
• No harassment, abuse, malicious code or illegal use.
• No reverse engineering or prohibited attempts to extract source code, subject to applicable law.

Subscriptions & Payments

• Pricing and applicable taxes.
• Billing cycle and renewal terms.
• Free trials, if offered.
• Cancellation and refund rules.
• Payment failures and subscription suspension.
• App-store payment rules where applicable.

Intellectual Property

• Define ownership of the app, software, brand, logos, UI/UX and other proprietary materials.
• Grant users a limited right/license to use the service.

User Content

• Address profile photos, feedback, messages or other content users may submit.
• Define ownership and any limited license needed to operate the service.

Third-Party Services

• Explain dependencies on third-party platforms and that third-party terms/policies may also apply.

Availability & Changes

• Service availability is not guaranteed.
• Maintenance, outages and OS changes may affect functionality.
• Features may be modified, added or removed.

Disclaimers & Liability

• Address limitations of screen-time measurements and third-party services.
• Include appropriate liability limitations and disclaimers reviewed for the jurisdictions where the service operates.

Suspension & Termination

• Define when accounts may be suspended or terminated.
• Explain what happens to access and stored data after termination.

Disputes & Governing Law

• Specify governing law.
• Specify jurisdiction and/or dispute-resolution process.
• Include arbitration provisions only if appropriate and legally reviewed.

Changes to Terms

• Explain how users will be notified of material changes.
• State when updated Terms become effective.

3. Recommended Additional Documents

• Parental/Family Monitoring Consent & Disclosure.
• Data Deletion Policy.
• Refund & Cancellation Policy, if the app is paid.
• Cookie Policy, if the website uses cookies/tracking.
• Acceptable Use Policy, particularly because the product includes monitoring features.

4. India / International Compliance Note

If the app is launching in India, the final documents should be reviewed against the Digital Personal Data Protection Act, 2023 and the rules/regulations applicable at the time of launch. If the app will be available internationally, additional requirements may apply depending on the user's location, including rules concerning children/minors, consent, data rights, cookies, cross-border transfers and consumer protection.

• Data retention periods.
• Privacy/contact email and grievance contact.
• Account/data deletion process.
